Welcome to Big Fish. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use Big Fish.
The short version: be respectful, don't post unsafe or illegal content, and remember that ocean activities carry real risk — Big Fish helps you find people, but you are responsible for your own safety.
1. Who can use Big Fish
You must be at least 13 years old. If you're between 13 and the age of majority in your country, you confirm a parent or guardian has reviewed these Terms. You also confirm the information you provide during onboarding (such as your certification level) is accurate.
2. Your account
You sign in with Apple Sign In. You're responsible for keeping your Apple ID secure and for everything that happens under your account. If you suspect unauthorized access, contact us right away.
3. The community standard
Big Fish is built on a healthy, curated community. By using the app you agree to:
- Treat other members with respect, regardless of skill, identity, or background.
- Use real photos and information about yourself.
- Only post plans you actually intend to host or attend.
- Be honest about your experience and certification level when joining a plan.
You agree not to:
- Post nudity, hateful content, harassment, threats, or anything illegal.
- Post content that promotes unsafe or destructive ocean practices (poaching, harming marine life, taking protected species, etc.).
- Solicit, scam, or use the app for commercial promotion without our written permission.
- Impersonate another person or pretend to be a certification you don't hold.
- Try to scrape, reverse engineer, or disrupt Big Fish's services.
We may remove content or accounts that break these rules at our discretion.
4. Plans, trips, and meeting in person
Important: Big Fish is a coordination tool, not a dive operator, travel agent, or guide. Diving, snorkeling, freediving, spearfishing, surfing, and ocean travel carry real and sometimes fatal risk. You participate at your own risk.
When you post or join a plan, you understand and agree that:
- You are responsible for verifying the qualifications, equipment, insurance, and intentions of the people you meet.
- You are responsible for assessing local conditions, weather, currents, and your own fitness on the day.
- Big Fish does not vet, certify, or guarantee any user, plan, location, or third-party operator.
- You should follow local laws, dive regulations, and protected-area rules at every spot.
5. Content you post
You keep ownership of the photos, videos, captions, and comments you post. By posting, you grant Big Fish a worldwide, non-exclusive, royalty-free license to host, display, and deliver that content as part of running the service (showing it on the map, in trip feeds, and in app previews).
You confirm that you have the right to post the content (you took the photo, or you have permission), and that posting it doesn't infringe anyone else's rights.
You can delete your own posts and comments at any time. We may also remove content that violates these Terms.
6. Subscription and payments
Big Fish offers an optional subscription (Big Fish Pro) processed through Apple and RevenueCat. Pricing is shown in-app before purchase. Subscriptions auto-renew unless you cancel at least 24 hours before the period ends. Manage or cancel your subscription anytime from Account → Subscription or in your iOS Settings.
Refunds for App Store purchases are handled by Apple per their policy.
7. The fish scanner
The Fish Scanner uses on-device image classification to suggest a likely species. It is informational and frequently wrong. Do not rely on it for safety, legality (e.g. spearfishing regulations), or scientific identification.
8. Suggested spots and curated content
Big Fish may surface curated destinations and plans to inspire you. These suggestions are editorial and don't imply we operate, vet, or recommend any specific operator at the destination.
9. Suspension and termination
We may suspend or terminate accounts that violate these Terms or harm the community. You can delete your own account anytime from Account → Account → Delete Account. Deletion is permanent and removes your profile, content, and history.
10. Disclaimers
Big Fish is provided "as is" and "as available". We don't guarantee that the service will be uninterrupted, error-free, or fit for any particular purpose, including the safety of any meet-up arranged through the app.
11. Limitation of liability
To the fullest extent allowed by law, Big Fish, its officers, and contributors are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app or from any plan, trip, or activity organized through it. Our total liability for direct damages is limited to the amount you've paid us in the previous 12 months, or USD $50, whichever is greater.
12. Indemnification
You agree to indemnify and hold Big Fish harmless from any claim or demand, including reasonable legal fees, made by a third party because of your use of the app, your content, or your conduct on a Big Fish plan or trip.
13. Changes to the service or Terms
We may change features and these Terms over time. For significant changes we'll notify you in-app and update the "Last updated" date. Continuing to use Big Fish after a change means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Big Fish is operated, without regard to conflict-of-laws rules. Disputes will be handled in the competent courts of that jurisdiction unless local consumer law gives you a different right.
